1. About the Service

SelfieAI ("the Service", "we", "us") is an AI-powered image generation platform operated by SelfieAI. The Service creates synthetic images using artificial intelligence based on user-uploaded photographs and reference imagery. No celebrity, public figure, or any third party endorses, sponsors, or is affiliated with this Service.

2. Age Restriction

You must be at least 18 years of age to use this Service. By using SelfieAI, you represent and warrant that you are 18 years or older. If you are under 18, you may not use this Service under any circumstances.

3. User Responsibilities and Warranties

By using this Service, you represent, warrant, and agree that:

• You have the right to upload and use the photographs you provide to the Service.
• You accept sole legal responsibility for all content created using the Service.
• You will not use generated images for commercial purposes without written authorization.
• You will not pass AI-generated selfies off as real, unmodified photographs.
• You will not use the Service to create content that is defamatory, fraudulent, harassing, or otherwise illegal.
• You understand that all generated images are AI-created and are for personal entertainment use only.

4. AI-Generated Content Disclosure

All images produced by the Service are AI-generated and are clearly labeled as such. The "AI-Generated" label is embedded in the image pixels and cannot be removed. This labeling complies with emerging content disclosure regulations and social media platform policies.

5. Celebrity Likeness

The Service may generate images featuring likenesses of public figures and celebrities. These images are AI-generated for entertainment purposes only. No celebrity or public figure has endorsed, sponsored, or participated in the creation of any image on this platform. The use of celebrity likenesses is provided for purposes of parody, commentary, and personal entertainment under fair use principles.

6. Indemnification

You agree to indemnify, defend, and hold harmless SelfieAI, its officers, directors, employees, agents, and affiliates from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to:

• Your use of the Service or any content you create using the Service.
• Claims of defamation, deepfakes, identity fraud, or misrepresentation.
• Your violation of these Terms of Service.
• Your violation of any rights of any third party.

7. Disclaimer of Warranties (AS-IS Provision)

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SELFIEAI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100.00).

9. Content Removal

We reserve the right to remove, disable, or restrict access to any content generated through the Service if we determine, in our sole discretion, that consent for the use of any person's likeness cannot be verified, or if the content violates these Terms or applicable law. We also comply with DMCA takedown requests as described in our DMCA Policy.

10. Personal Entertainment Use Only

Generated content is strictly for personal entertainment purposes. You may not use generated images for:

• Commercial purposes, advertising, or promotional materials.
• Creating false endorsements or misleading representations.
• Any purpose that could be considered defamatory, harassing, or harmful.
• Distribution as real photographs or misrepresentation of AI-generated content as authentic.

11. Payment and Refunds

Payments are processed via Pix (Brazil) or Stripe (international) and are non-refundable after image generation has begun. In case of technical failure preventing generation, the full amount will be refunded. Token purchases are non-refundable once credited to your account.

12. Image Availability

Generated images are available for download for 7 days after generation. After this period, images are permanently deleted from our servers and cannot be recovered.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. Changes will be effective upon posting the updated Terms on this page. Your continued use of the Service after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. For users in Brazil, the Consumer Defense Code (Lei 8.078/1990) and applicable Brazilian laws shall also apply.
